1. Acceptance of Terms
By accessing or using the Wood Chalets Ella website (the “Site”), including any pages, features, content, booking tools, or services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Site.
These Terms constitute a legally binding agreement between you and Wood Chalets Ella (referred to as “Hotel,” “we,” “us,” or “our”), located at Ella, Badulla Road, Bandarawela, Uva Province, Sri Lanka.
We may update these Terms from time to time. Continued use of the Site after changes constitutes your acceptance of the revised Terms. We encourage you to review them periodically.
2. Use of the Site
- You must be at least 18 years old or the age of majority in your jurisdiction to use the Site.
- You agree to use the Site only for lawful purposes and in accordance with these Terms.
- The Site is intended for personal, non-commercial use unless otherwise agreed in writing.
3. Reservations and Bookings
- All reservations made through the Site or linked booking system (e.g., reserve.woodchaletsella.com.lk) are subject to availability and confirmation by the Hotel.
- Rates displayed are in Sri Lankan Rupees (LKR) or as specified, inclusive/exclusive of taxes as indicated. Additional charges (e.g., service fees, tourism taxes) may apply.
- Check-in / Check-out: Check-in is available 24 hours (subject to availability). Standard check-out is 12:00 PM. Late check-out is subject to availability and additional charges.
- Bookings are binding once confirmed. You will receive a confirmation email or notification.
- We reserve the right to cancel or modify reservations in cases of suspected fraud, error in pricing, or unavailability.
Meal Plans and Amenities: Room-only, Bed & Breakfast, Half Board, and Full Board options are available as described on the Site.
4. Payments, Cancellations, and Refunds
- Payments can be made via accepted methods (credit/debit cards, cash, Lanka QR, etc.).
- Cancellation and refund policies vary by rate type and are specified at the time of booking. Generally:
- Free cancellation may apply up to a certain number of days before arrival.
- No-shows or late cancellations may incur full or partial charges.
- Refunds, where applicable, will be processed to the original payment method within a reasonable time.
- We are not responsible for charges by third-party booking platforms.
5. Intellectual Property
All content on the Site, including text, images, logos, photos, videos, and design elements, is the property of Wood Chalets Ella or its licensors and protected by copyright, trademark, and other intellectual property laws of Sri Lanka and international treaties.
You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
6. User Content and Reviews
- You may submit reviews, comments, or other content (“User Content”).
- By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual license to use, display, and reproduce it.
- You represent that your content is accurate, non-infringing, and does not contain defamatory, obscene, or unlawful material.
- We reserve the right to remove any User Content at our discretion.
7. Prohibited Activities
You agree not to:
- Use the Site for any illegal purpose or to transmit harmful code.
- Attempt to gain unauthorized access to any part of the Site.
- Interfere with the proper functioning of the Site.
- Scrape, copy, or harvest content without permission.
- Impersonate any person or entity.
8. Privacy and Data Protection
Your use of the Site is also governed by our Privacy Policy. By using the Site, you consent to the collection and use of your personal information as described therein. We comply with applicable Sri Lankan data protection laws.
9. Disclaimers and Limitations of Liability
- The Site and its content are provided “as is” without warranties of any kind, express or implied.
- We do not guarantee uninterrupted access, error-free operation, or that the Site is free from viruses.
- To the fullest extent permitted by law, the Hotel shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or any booking.
- Our total liability shall not exceed the amount paid by you for the relevant booking (if any).
We are not responsible for the accuracy of third-party links or content.
10. Force Majeure
We are not liable for delays or failures in performance caused by events beyond our reasonable control (e.g., natural disasters, pandemics, government restrictions, strikes, or acts of God).
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
Any disputes arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Sri Lanka, located in the relevant district (e.g., Badulla).
12. General Provisions
- If any provision of these Terms is held invalid, the remainder shall continue in full force.
- Our failure to enforce any right does not constitute a waiver.
- These Terms, together with any booking confirmation, constitute the entire agreement between you and the Hotel regarding the Site.
- Headings are for convenience only and do not affect interpretation.
